We need to find out about doing a Temp. Guardianship in Texas. This is NOT CPS related (Thankfully and for once! LOL!)

Long story short: my significant other's son is a teenager with a multitude of problems. Despite constant therapy and medications for the past 5 years, things are not improving, and as of late, he is more and more defiant and difficult, in general making home life miserable for everyone else (including the other 3 kids in the house). He is unhappy here and so is everyone else. :cry:

A long time family friend (very much like a Godmother) who's known him almost all his life and is already very involved in his life has consented to having him come live with her (same city).... and we need/want to do temp. guardianship so that she will have the ability to take him to counseling appointments, the doctor, change doctors if needed, deal with school, authorize medical, blah blah blah. Everyone agrees all around that this is best for him and best for the other kids. The guardian in question has no kids and has the resources (time!) to focus on him completely. He would just be a bus ride away and would still come here often but would live with the Godmother. It's something we are trying before the next step (residential treatment)... which we hope to avoid if possible.

So, is this something we can just print out and have notarized and that's it? Or must the courts be involved?

We don't want her to hit roadblocks when trying to just do ordinary things, like discuss him with a counselor, or discuss his grades with a teacher, or take him for a physical, etc. We'd like to set it up for one year then renew it as needed.

I've looked at some of the forms you can order but I'm not sure about ordering sight-unseen only to find out the form might not apply in our situation.... we don't want something that pertains to the death or disability of his parent, but rather something for right now, that will allow her to take him into her home but will not affect any legal parental rights.

Finally, related to my post's subject: What is the difference between Parental POA and Guardianship? Seems like either will work but surely there is a difference?

Call or go to the Clerk of the Court and ask them about a court form and filing fee. Ask them if it has to be filed in court in order for the schools and doctors to recongnize it.

Then ask them if you had an attorney could you do it privately, with a notorized statement. Then ask them if there is a legal form for this. If so, what is it called. Then ask them if you can do it without an attorney. If so, what is it called.

Then call the school district and ask them for written policies on students living with a guardian - what documentation is required to verify that a student resides with a guardian. This issue comes up fairly often because people do this in order to get their kids into better schools.

Call your healthcare provider and ask how to do a Medical Consent form for a minor.

Verify everything you are told by looking it up and getting it in writing.


Ask a lot of different people, and if people say different things, then confront them about it and ask for written documentation.
